TNEB cannot deny connection to private buildings in government promboke lands- Madras High Court [Saturday, September 19, 2009]
The Madras High Court said that the Tamil Nadu Electricity Board cannot refuse to provide electricity connections to private commercial or industrial buildings constructed on Government 'Poromboke' lands. The court allowed a writ petition filed by a petty shop owner in Madurai Bench. Justice T S Sivagnanam, who allowed the writ petition said that according to the TNEB Amendment Code, 2004, it does not differntiate between residential and commercial buildings. The judge also said that the regulation 27(12) of the Code states that electricity connections should be provided on government land if the applicant produces a no objection certificate from the officers not below the rank of a Deputy Tahsildar.
